Terms of Service

1. Acceptance of Terms
By creating an account or using Calls to Booking ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.
2. Service Description
Calls to Booking provides an automated missed-call recovery and online appointment booking service. The Service sends SMS messages on your behalf to consumers who have either (a) called your business number, in which case any reply text is treated as a 1:1 customer-care response, or (b) submitted your online booking form and explicitly opted in to receive text messages. The Service captures lead information and facilitates appointment booking, reminders, and follow-ups.
3. Acceptable Use
You agree to use the Service only for legitimate, transactional business communication with consumers who have either contacted you by phone or affirmatively opted in via your booking page. You must not:
- Use the Service to send marketing or promotional messages to consumers who have not opted in
- Use the Service in violation of the Telephone Consumer Protection Act (TCPA), CTIA Messaging Principles & Best Practices, or any applicable law
- Misrepresent your business identity in automated messages
- Modify the SMS-consent disclosure on the booking page or otherwise undermine the opt-in record
- Resell or sublicense access to the Service
4. Billing and Payments
The Service requires a one-time setup fee of $500 and a monthly subscription of $500. Subscriptions are billed monthly in advance. Failure to pay may result in suspension of the Service. Setup fees are non-refundable. Monthly fees are non-refundable for the current billing period.
5. Cancellation
You may cancel your subscription at any time. Your account will remain active through the end of the current billing period. No prorated refunds are provided.
6. SMS Compliance
You are responsible for ensuring your use of the Service complies with TCPA, the CTIA Messaging Principles & Best Practices, and all applicable regulations. The Service sends SMS only via the two consent paths described in our Privacy Policy — (a) explicit web-form opt-in via the booking page checkbox, or (b) 1:1 customer-care replies to consumers who initiated contact by phone. STOP opt-out and HELP requests are processed automatically and per-business by the Service.
7. Limitation of Liability
To the fullest extent permitted by law, Calls to Booking shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount paid by you in the three months preceding the claim.
8. Termination
We reserve the right to suspend or terminate accounts that violate these Terms, misuse the SMS platform, or engage in fraudulent activity, without refund.
